In March 2024, authorities in Russian-occupied Crimea raided the homes of several Crimean Tatar Muslims, including Mustafayev, and arrested him. Authorities accused him of being a member of Hizb ut-Tahrir, a religious organization banned in Russia but not in Ukraine.

In May 2026, authorities sentenced Mustafayev to 14 years' imprisonment on charges of terrorism (Art. 205.5-2 RCC).
